  • if your total income is less than ₹5 lakh, the fee is ₹1,000; 
  • if your total income exceeds ₹5 lakh, the fee increases to ₹5,000. 

Consequences of Late Filing: Loss Carryforward and Interest Penalties 

  • One significant drawback is the limitation on carrying forward losses. If you file a belated return, you can only carry forward losses under income from house property. Losses from other sources, such as capital gains or business losses, cannot be carried forward, potentially impacting your future tax liabilities. 
  • Additionally, late filing attracts interest penalties under Section 234A of the Income Tax Act. The tax department levies interest at a rate of 1% per month on the outstanding tax liability from the original filing deadline of July 31, 2024. 
  • Late filing can also result in the loss of certain exemptions and deductions that are otherwise available to taxpayers. For instance, you might miss out on deductions under Section 80C for investments like life insurance premiums, PPF contributions, and EPF contributions, as well as deductions under Section 80D for health insurance premiums. Other tax-saving deductions under Sections 80E, 80G, and 80GGA may also be forfeited. 
  • Failing to file your Income Tax Return, even a belated one, carries severe legal risks. If you miss the final filing deadline, the Income Tax Department may initiate prosecution proceedings under Section 276CC of the Income Tax Act. In extreme cases, willful defaulters may face imprisonment for up to 7 years. In addition to imprisonment, you may also be subjected to further monetary fines.

3.  Log in to the Income Tax Portal: Visit the official Income Tax Department website and log in using your PAN and password.

4.  Choose the Correct ITR Form: Select the appropriate ITR form based on your income type (e.g., ITR-1 for salaried individuals, ITR-2/3 for other income sources).

5.  Fill in Your Income Details: Accurately enter all required details, including income, deductions, and tax payments. Double-check all entries.

6.  Submit the Return: After a thorough review, submit your return online. You'll receive an acknowledgment receipt upon successful filing.

7.  Pay Late Fee and Penalties: Pay the applicable late filing fee and any outstanding taxes due. Ensure you keep records of these payments.
